If you aren't making a profit there are no legal issues, it's fair usage. And it is original, just because you sample something else doesn't mean it's the exact same thing, if you wanna use that logic then all songs with similar riffs are all unoriginal

Creative commons etc, if even the slightest penny is made, even if you aren't getting it, you can get in shit. How would you like it if you made a really awesome song, and then someone stole parts from it when you specifically didn't want anyone to, and then released it on an album you'd never heard of before, and they gained massive publicity from it, etc etc

Pretty good! Work on it for a few more hours or so and you should have a great song.
