The problem with machinima is that they are corporate and nothing else, only select content that has enough seananners or other tags that they believe give them hits and generally have NOTHING to do with machinima anymore, they have narrated gameplay, animated series and shows that should have died a long time ago but are still being pushed and one thing oyu oculd remotely call a machinima, which is Sanity not Included. Everything else that has scenes from a game is just head bobbing with awful people talking aobut awful shit that I don't dare to identify as Machinima.

Also they basically make all creative decisions and pretty much every employee has voiced that they are unhappy with some changes to their formats many times.

Just look at Inside Gaming, the daily format was a nice idea, but now the weekly show is some shitty animation and the whole thing is overall all over the place and only kept afloat by TDP/Adam and the sidekick Matt, every bit of creative intro etc. has been cut by the corporate department.

Youtube Partner? Depends on how many videos with how many views. Machinima? Depends on your contract, but it's "bare minimum".

All depends on your traffic. I earn a comfy $50.00 USD a day off of just monitization which doesn't require a partnership.

His best bet is to try and make Machinima breach their contractual obligations. I don't know the contract, but I would probably make neo nazi videos and post them via Machinima until they agreed to dissolving the contract.

That's of course assuming that Machinima is required to upload videos their partners create. It would be much easier I knew what was exactly in the contract.

The contract was posted on the last page.

The entire contract is null and void (at least in the EU) because you cannot tie a person into a lifelong contract. Time and time again the courts have ruled against those that have attempted to have people sign them (or have been signed into them).
Hell the content you make doesn't even belong to Machinima. If you read the contract (specifically sections 4 and 11) your content and channel belong to you, the Director.

Any lawyer would have an easy time picking through the contract. The fact Machinima are honouring the contract with so many holes in it is amazing.

Machinima (The network) used to be neat, they had a small selection of series (like 4-5) and they were all rather good

Until Arby n' the Chief started to be milked to death with a fuck load of episodes that just didn't had the quality anymore.

Arby n' the Chief is split into three shows now because Jon was urged to produce faster but didn't want to loose the plot even more, so he started a second (spin off) show, and now a third to keep up with demand.

    10$ a day is 300$ a month and that helps a lot when you're a student

Didn't Machinima pretty much kill the machinima scene? When they formed a company, they outright deleted their forums without any warning, destroying one of the largest machinima communities. I've yet to find any other communities...

How the hell do you make $50 a day when your average video view is only around 3k or so

Because last I checked the only people who actually made any money over a couple a bucks here and there a day were partners who generally roll in 10k-20k+ views for every video they post

free lawyers are notoriously shit. i guess he could do that but his chances of winning the case would be pretty low against the money machinima has

having lengthy court proceedings that could possibly take many years still takes a financial toll on people anyway, especially when it's someone like a kid who makes youtube videos and probably doesn't have a high and/or steady income

he doesn't have a case anyway. machinima haven't done anything illegal
In a fairly large amount of cases in perpetuity contracts are seen as unethical and immoral and are often pronounced void and without merit.

It's essentially why companies do add non compete clauses when you quit but these non compete clauses tend to be limited for a year or similar.

On top of that, the bigger issue in the contract, is that it gives sole discretion to machinima to terminate the contract, but does not allow the other party any chance of terminating it at all.

Overall I'd say that a contract like this wouldn't actually hold in front of a court. Of course the kid should have read the contract first before signing it.

But from what I looked at the contract, it was penned by a first year law student who was told to make "a really fucking cool contract that gives us loads of power" because the thing is broken back and forth. In perpetuity account with single party discretion would go bonkers anywhere.

No he's not. All Machinima does is take videos from that specific channel.

He could easily make a new one without an issue.

Someone posted the contract and he can't. Essentially machinima first specifies the youtube accounts and then adds in any potential future accounts created and or used by the person in question. So the guy could potentially make an account on a different video site, but not on youtube.

    EDIT

Of course there's multiple versions of the supposed contract floating around right now. Some people are saying there's a 1 year grace period. The one I read did not have this.

Isn't the simple act of posting this breaching the contract? Is says it's not to be disclosed.

Unless he wasn't the one who posted it.

Life long contract sounds crazy. What if he wanted to change careers? I mean I'm really trying to make sesne of it all. It sounds almost unrealistic.

    Hint:
If an email adressed to you states "DONT POST THIS N PUBLIC :CCCCCC" it doesn't mean shit.

    Edited:

Ergo, if they sent that to someone who declined, he can post it wherever he wants, not to mention that a contract often can be opened to third parties anyway.

My channel has been highlighted to be a YouTube partner for about 1 year already, think its not really worth it and i'm afraid that my vids are going to be deleted

Just start doing things the contract doesn't allowed you to do, then they will have to start a lawsuit.

He is in England, they're in California.

International cases aren't within Machinima's scope.

He's either faking it or pretty dumb.

I steal content from people all the time. They email me and depending on their level of politeness I remove/take it down. But if they start fucking with me, I just keep using it. I'm in Denmark, they're in America. International Copyright cases are out of most people's(and even organization's) scopes.
